Terms of Use / Terms and Conditions

Article 1 – Definitions

In these terms, the following definitions apply:

  • Withdrawal Period: The time period during which the consumer can exercise their right of withdrawal.
  • Consumer: A natural person who is not acting within the scope of business activity and enters into a distance contract with the entrepreneur.
  • Day: Calendar day.
  • Ongoing Contract: A distance contract concerning a series of products and/or services, where delivery and/or purchase obligations are spread over time.
  • Durable Medium: Any means that allows the consumer or entrepreneur to store information addressed to them in a way that enables future access and unchanged reproduction.
  • Right of Withdrawal: The consumer's opportunity to withdraw from the distance contract within the withdrawal period.
  • Entrepreneur: The natural or legal person offering products and/or services at a distance to consumers.
  • Distance Contract: A contract concluded within the framework of an organized system for distance selling, exclusively using one or more means of distance communication.
  • Means of Distance Communication: Methods used to conclude a contract without the consumer and entrepreneur being in the same room.
  • General Terms: These general terms and conditions for the entrepreneur.

Article 3 – Applicability

  • These terms apply to all offers, distance contracts, and orders between the entrepreneur and the consumer.
  • The terms are made available to the consumer before the distance contract is concluded. If not possible, the location where the terms can be read is indicated, and they are sent free of charge on request.
  • For electronic contracts, the terms are made available in a way that allows storage and access.
  • In case of conflict between general and specific terms, the most favorable provision for the consumer applies.
  • If any provision is invalid, the remaining provisions continue to apply, and a replacement provision is introduced.
  • Unregulated situations shall be interpreted according to these terms.
  • Ambiguities in interpretation shall be clarified according to the terms.

Article 4 – The Offer

  • If an offer has a limited validity period or special conditions, this is expressly stated.
  • Offers are non-binding. The entrepreneur can change or withdraw the offer.
  • The offer contains a complete and accurate description of the products/services. Images are for guidance, but colors may differ depending on the screen.
  • The consumer receives clear information about:
    • Price (excluding customs and import VAT, these costs are paid by the buyer)
    • Shipping costs
    • How contracts are concluded
    • Whether the right of withdrawal applies
    • Payment, delivery, and performance methods
    • Acceptance period and price guarantee
    • Costs for distance communication (if other than regular rates)
    • Archiving of contracts and how the consumer can access it
    • The possibility to check and correct entered information
    • Languages in which the contract can be concluded
    • The entrepreneur’s codes of conduct and how they can be consulted
    • Minimum contract period for long-term contracts
    • (Optional) available sizes, colors, materials

Article 5 – Conclusion of the Contract

  • The contract is concluded when the consumer accepts the offer and fulfills the conditions.
  • For electronic contracts, the entrepreneur confirms receipt electronically. Before confirmation, the consumer has the right to withdraw.
  • The entrepreneur takes appropriate security measures for electronic transactions.
  • The entrepreneur can check the consumer’s payment ability and refuse or set special conditions on valid grounds.
  • Upon delivery or on a durable medium, the entrepreneur provides:
    • The entrepreneur’s address for complaints
    • Information about the right of withdrawal or if it is excluded
    • Information about guarantee and after-sales service
    • Details according to Article 4, if not already provided
    • Terms for termination of long-term contracts
    • For ongoing contracts, the above information is only given at the first delivery.
  • All contracts are subject to product availability.

Article 6 – Right of Withdrawal

  • The consumer has the right to withdraw from the purchase of a product within 14 days without giving any reason, counting from the day after receipt.
  • During the withdrawal period, the product and packaging must be handled carefully and only used to determine the product’s characteristics.
  • To exercise the right of withdrawal, the consumer must notify the entrepreneur in writing (email is sufficient) within 14 days and return the product within 14 days of notification, with proof of return.
  • If the consumer does not notify or return within the specified time, the purchase becomes binding.

Article 7 – Costs in Case of Withdrawal

  • Return costs are paid by the consumer.
  • If payment has been made, the entrepreneur refunds the amount as soon as possible, but no later than 14 days after withdrawal, provided the item has been received or return can be proven.

Article 8 – Exceptions to the Right of Withdrawal

  • The right of withdrawal may be excluded for certain products/services if this is clearly stated before purchase.
  • Exceptions apply to:
    • Products manufactured according to consumer’s instructions or are personal
    • Products that cannot be returned due to their nature or deteriorate quickly
    • Newspapers/magazines, audio/video/software, or hygiene products with broken seals
  • Exceptions for services apply to:
    • Accommodation, transport, restaurant, or leisure activities on a specific day/period
    • Services commenced with the consumer’s explicit consent before the withdrawal period ends
    • Games and lotteries

Article 9 – Prices

  • Prices are fixed during the offer period, except for changes in VAT.
  • Variable prices may apply if market changes require it, which is stated.
  • Price increases within 3 months are only allowed due to legal changes.
  • Price increases after 3 months must be informed about and give the consumer the right to terminate the contract.
  • Delivery is outside the EU; import VAT and customs are charged by the delivery partner.
  • Prices are subject to misprints. The entrepreneur is not obliged to deliver at incorrect prices.

Article 10 – Product Compliance and Guarantee

  • The entrepreneur guarantees that the products/services comply with the contract, reasonable expectations, and applicable laws.
  • Manufacturer/importer guarantees do not affect the consumer’s legal rights.
  • Defects or incorrect deliveries must be reported in writing within 14 days and returned in unopened, unused original packaging.
  • The guarantee does not apply if:
    • The consumer or third party has repaired/altered the product
    • The product has been misused or used contrary to instructions
    • The defect is due to official regulations regarding material quality

Article 11 – Delivery and Performance

  • The entrepreneur handles orders with the utmost care.
  • Delivery is made to the address provided by the consumer.
  • Orders are processed as soon as possible, at the latest within 30 days unless otherwise agreed. In case of delay or incomplete delivery, the consumer is informed within 30 days, with the right to cancel the purchase and be refunded within 14 days.
  • If delivery is not possible, a replacement item is offered; the right of withdrawal still applies.
  • The risk of damage/loss passes to the consumer upon receipt.

Article 12 – Ongoing Contracts: Termination and Extension

  • Termination: The consumer can terminate ongoing or fixed-term contracts for regular delivery of products/services at any time, with a notice period of no more than one month.
  • Extension: Fixed-term contracts may not be extended automatically, except for certain products (e.g., magazines).
  • Duration: For contracts over one year, the consumer can terminate after one year with one month’s notice unless otherwise agreed.

Article 13 – Payment

  • Unless otherwise agreed, payment is due within 7 business days after the withdrawal period begins.
  • The consumer must immediately report errors in payment information.
  • In case of non-payment, the entrepreneur has the right to charge reasonable fees, if this has been notified in advance.

Article 14 – Complaints Handling

  • Complaints must be submitted in writing and clearly described within 7 days after the defect is discovered.
  • Complaints are answered within 14 days. If more time is needed, the consumer is informed.
  • If the complaint cannot be resolved, a dispute arises to be handled according to the dispute resolution procedure.
  • Complaints do not exempt the consumer from payment obligations unless otherwise stated.
  • In the case of justified complaints, the product is replaced or repaired free of charge.

Article 15 – Disputes

  • Contracts according to these terms are governed by Dutch law, regardless of the consumer’s residence.

Article 16 – CESOP

  • In accordance with the 2024 Payment Service Provider Directive (CESOP), payment providers may register data in the European CESOP system.
